O R D E R

This petition has been filed to direct the respondent police to give necessary police protection to the petitioner to do his cultivating work at the tender land belongs to Arulmigu Subrmaniysamy Temple, Tiruparankundram by considering his representation dated 17.12.2016.

2.It is the case of the petitioner that Arulmigu Subramaniyasamy Temple, Thirupparankundram, Madurai, called for tender on 20.05.2016 for cultivating tenant for the agricultural land belonging to the temple and that this petitioner being the highest bidder had bagged the tender, pursuant to which, the Temple administration entered into a tender agreement with the petitioner on 13.07.2016 for the period from 01.07.2016 to 30.06.2019. It is his further case that on 03.10.2016, the https://hcservices.ecourts.gov.in/hcservices/

revenue officials and Temple officials measured the land and handed over the same to the petitioner. While so, it is the grievance of the petitioner that the owner of the neighbouring land, namely one Rasuthevar and his son Maharajan are preventing the petitioner from enjoying the said land and therefore, the petitioner has given a complaint, for which, no action was taken. Hence, the petitioner is before this Court seeking police protection.

When the matter was taken up, the learned Government Advocate (Crl side) submitted that on the complaint given by the petitioner, the respondent police registered a case in Crime No.188/2017 on 21.03.2017 under Sections 294(b), 506(ii) IPC against Rasuthevar and Maharajan and investigation is pending.

4. Under such circumstances, this Court directs the respondent police to ensure sufficient protection to the petitioner, so that there is no disturbance to him in cultivating the land that has been taken by him in auction through the Temple.
