ORDER

This Criminal Original Petition is filed to direct the respondents to conduct investigation on the basis of the petitioner's complaint, dated 16.08.2016 and to register case and to take appropriate action within the time stipulated by this Court.

2. Heard both sides.

3. The learned Government Advocate (Criminal side) filed counter affidavit, wherein at paragraph 7 it is stated as follows:- "7. ... As per the Tamil Nadu Local Bodies Ombudsman Act, 2014, the institution of Ombudsman has been established to cause enquiries into the allegation of corruption/maladministration against such public servants coming under the local bodies. The Tamil Nadu Local Bodies https://hcservices.ecourts.gov.in/hcservices/

Ombudsman (manner of filing inquiry and disposal complaints) Rules 2015 specifically provide for furnishing of complaints in the prescribed format by the complainant. Hence, the original petitions were returned back to the petitioner vide Ref.No.6565/2016/PUB/KK, dated 26.08.2016 and 6567/2016/PUB/KK, dated 26.08.2016 respectively for pursuing further action under Tamil Nadu Local Bodies Ombudsman Act, 2014, along with a copy of the Act, Rules and Proforma."

4. In view of the above stated position, the criminal original petition is dismissed with liberty to the petitioner to approach the competent authority.
