Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to direct the 3rd respondent police give adequate police protection for life and limb of the petitioner for the basis of petitioner's representation dated on 14.02.2026 within the period stipulated by this Court in accordance with law.

ORDER

Seeking to direct the 3rd respondent to protect the petitioner's crops in his agricultural land situated in Survey Nos.71/9, 71/11 and 71/13 measuring 1 Acre and 35 Cents situated at Balakrishnampatti Village, Thuraiyur Taluk, Tiruchirappali District, this criminal original petition is filed.

2. Since no adverse order is passed against the private respondents, notice to the private respondents is dispensed with. 2/6

The learned counsel for the petitioner submitted that the petitioner is the absolute owner in possession and title of the aforesaid property under a registered sale deed dated 08.08.2022 vide Document No.2057/2022 and he had been in possession and enjoyment of the property exclusively to the knowledge of everyone and he had also obtained crop loan on 27.12.2024 and had cultivated the said land. However, respondents 4 to 6 are hindering the petitioner from harvesting the agricultural produce. Hence, this petition.

4. The learned Government Advocate(Crl.side) submitted that C.S.R has been issued and enquiry was conducted. Since the civil suit is pending, the parties were advised to approach civil Court.

5. Heard the learned counsel on either side and carefully perused the materials available on record.

6. Though it is the categorical contention of the learned counsel for the petitioner that the 6th respondent had in no way any title over the 3/6

said property to lease out the land to the 4th respondent and he should be permitted to harvest the agricultural produce, it is seen that already a civil suit is pending between the respective parties and the police had already conducted an enquiry and had advised the parties to work out the remedy before the civil forum by lodging a civil case for the same set of facts. Filing a criminal original petition before this Court will not entitle the petitioner to seek police protection at this instance where a civil suit is pending.

In view of the same, this Criminal Original Petition is disposed of, directing the petitioner to take necessary steps to conclude the civil proceedings before the civil forum and obtain a proper civil decree and thereafter, approach the 3rd respondent for necessary police protection. 26.02.2026 NCC : Yes / No Index : Yes / No Internet : Yes/ No gbg 4/6
