For Respondent : Mr.S.Chandrasekar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.215 of 2020 on the file of the respondent police ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. 2.The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 420 of I.P.C., and Section 15(3) of the Indian Medical Council Act, 1956 in Crime No.215 of 2020 on the file of the respondent police, seeks anticipatory bail.
3.Based on the complaint given by the Chief Medical Officer, Government Hospital, Mailampatti, a case has been registered against the petitioner for practicing allopathy treatment without possessing requisite qualification. Allopathy medicines were recovered from the premises of the petitioner.

CRL OP(MD). No.5367 of 2020 4.The learned counsel for the petitioner would submit that the petitioner is not giving allopathy treatment and in fact, he stored the medicines for conducting free medical aid through trust and he has also enclosed trust deed.
5.Based on the complaint given by the public to the Collector that medicine waste from his clinic were thrown in the municipal dumpyard, the Chief Medical Officer has inspected the premises of the petitioner and seized allopathy medicines from his premises. This is not a fit case for granting anticipatory bail, since custodial interrogation is necessary to ascertain as to whether the petitioner is having qualification for giving allopathy treatment or he got permission to conduct free medical camp. Hence, this Court is not inclined to grant anticipatory bail to the petitioner and this criminal original petition is dismissed.
