On the complaint lodged by Vivetha, the respondent police registered a case in Crime No.1 of 2017, on 13.01.2017, for offences under Sections 498(A), 406, 506(i) of the Indian Penal Code, 4 of Dowry Prohibition Act, 1961 and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002, against six accused including the petitioner herein, who has been arrayed as Accused No.1.
2. Admittedly, the petitioner is working as a Waiter in a Ship and he is required to take voyages frequently. At the time when the First Information Report was registered, the respondent police had issued a lookout circular for apprehending the petitioner as and when he enters or leaves India. The petitioner has been released on anticipatory bail by this Court in Crl.O.P.(MD)No.1522 of 2017 on 13.02.2017 and that apart, this Court has granted stay of the investigation in Crime No.1 of 2017 in Crl.O.P.(MD)No.2970 of 2017 on 16.03.2017. Under such circumstances, it may not be https://hcservices.ecourts.gov.in/hcservices/
necessary to keep the lookout circular alive, especially, in the light of the fact that the petitioner is an Indian citizen and the case in Crime No.1 of 2017 has also been stayed by this Court. Therefore, this Court directs the respondent police to recall the lookout circular, within a period of one week from the date of receipt of a copy of this order.
