ORDER
The present writ petition is filed for the following relief:- "Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the Respondents No.1 to 3 to give prior permission under the provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015 and the Adoption Regulations, 2022, within a time frame to be fixed by this Court and directing the Respondent No. 4 to correct the birth certificate of the said minor child by incorporating the names of the adoptive parents and issue a fresh birth certificate to the petitioner within a stipulated time. And pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice"

2. Heard Mr.M.A.Khadar Sheriff, learned counsel for petitioner, Mr.M.Lingadurai, learned Special Government Pleader for respondents 1 to 3 and Mr.K.K.Kannan, learned Standing Counsel for R4.
3. By consent, the writ petition is taken up for final disposal at the admission stage itself.

Upon hearing the learned counsel appearing for the petitioner and upon perusal of the materials available on record, the grievance of the petitioner is that he and his wife adopted a child, namely Mohammed Jamal, who was born to J.Magthun Mavulana and M. Jennifer Rani on 18.08.2019, by way of a duly registered Adoption Deed dated 10.06.2024. From the date of adoption, the petitioner and his wife have been treating the said child as their own son. It is further submitted that the said child, Mohammed Jamal, is presently studying in the 2nd Standard and is about to appear for his annual examinations. In this regard, the petitioner has made an application dated 10.02.2026 before the 1st respondent, under the provisions of the Adoption Regulations, 2022, seeking to substitute the names of the petitioner and his wife as the father and mother of the child in the Birth Certificate, by making 3/6
appropriate entries in the relevant column as per the said Regulations, and to issue a fresh Birth Certificate reflecting the same. However, the same has not been considered till date. Therefore, the petitioner is before this Court.
5. In view thereof, this writ petition is disposed on the following terms:- i. The 1st respondent is directed to consider the application of the petitioner dated 10.02.2026 and pass appropriate orders, in accordance with law, enabling the Birth Registering Authority to substitute the names of the petitioner and his wife in the columns relating to Father and Mother as the adoptive parents in the birth certificate of the child, namely Mohammed Jamal; ii. The aforesaid exercise shall be completed as expeditiously as possible not later than eight weeks from the date of receipt of a web copy of the order, without waiting for the certified copies of the order;
iii. No costs.
