Respondents Prayer:- Habeas Corpus Petition is filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus directing the respondents to produce in person or body of the petitioner's son namely Balaraman, Son of C.Mokkapandi, aged about 18 years, who has been illegally detained by the third respondent and produce him before this Court and set him at liberty and pass such further or other orders. ORDER

(Order of the Court was made by A.SELVAM, J) This Habeas Corpus Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents 1 and 2 to trace out and produce the detenu by name Balaraman, son of the petitioner.

2. The learned counsel appearing for the petitioner is present whereas the petitioner has failed to make his appearance.

3. The second respondent viz., the Inspector of Police, Batlagundu Town Police Station has produced the alleged detenu and the alleged detenu has stated that he married one Uma and now both of them are residing at Theni.

4. Considering the aforesaid factual circumstances, the relief sought for in the petition has become infructuous and therefore this Habeas Corpus Petition deserves to be dismissed.

5. In fine, this Habeas Corpus Petition deserves dismissal and accordingly is dismissed.
