The petitioner seeks production of the person of his minor children Bagavathi Ritil, aged about 12 years old and Malayala Lakshan, aged about 10 years.
2. According to the petitioner, the third respondent, who is his mother-in-law, is detaining the children illegally.

H.C.P.(MD) No.517 of 2022 upon instructions, would submit that the mother of the children committed suicide on 28.02.2022 and a case was registered under Section 174 Cr.P.C and on the death of the wife of the petitioner, it has been altered to 306 of I.P.C and the anticipatory bail petition filed by the petitioner is pending before this Court.
4. In such circumstances, we do not find that the custody of the children with the third respondent could be termed as a illegal custody. We do not see any case in order to enable us to invoke the jurisdiction under Article 226 of the Constitution of India. This Habeas Corpus Petition is therefore dismissed leaving it open to the petitioner to move appropriate civil Court seeking custody of the children.
