Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, to direct the respondents 2 to 4 not to insist for transportation pass for our vehicle, a car bearing Registration No.TN 02 BL 9001, which was used for transportation of the harvested agricultural produce from our farm consisting an are of 7.14 acres land comprised in Survey No.1332 of Naranapuram Pakuthy-2, Sivagiri Taluk, Tenkasi District, in terms of the G.O.Ms.No.217, dated 03.05.2020 issued by the Tamil Nadu Revenue and Disaster Management (DM-II) Department.

ORDER

Heard the learned counsel on either side.

2.The petitioner's case is that she is owning a sedan car bearing registration No.TN 02 BL 9001 and Jeep bearing Registration No.TN 01 AV 7949. The petitioner is an agriculturist. The petitioner is therefore in need of having to utilise those two https://hcservices.ecourts.gov.in/hcservices/

vehicles for transporting the agricultural produce from his farm. In the petition itself, the location of the farm has been mentioned. When the petitioner approached the District Collector, she was informed that no E.Pass is required for transportation of agricultural produce. But then, the petitioner's grievance is that the revenue as well as the local police are creating impediments and are insisting on production of E.Pass.

3.Taking into account all these aspects, interest of justice will be served by directing the first respondent to issue a formal proceeding which will enable the petitioner to deploy her vehicles for transporting her agricultural produce. The first respondent will issue such permission proceedings forthwith and without any delay. The Writ Petition is allowed on these terms. No costs.
