O R D E R
(Order of the Court was made by P.R.SHIVAKUMAR.,J.) K.Dhanam, W/o.Kaliyappan is the petitioner herein. She has filed this Habeas Corpus Petition seeking issuance of a Writ of Habeas Corpus for the production of her son Amarnathan S/o.Kaliyappan, aged about 60 years and set him at liberty.
2.Complaining that her son Amarnathan was missing from 01.11.2015 at about 07.00 a.m. and expressing apprehension that he would have been abducted by others for ransom, the petitioner preferred a complaint before the second respondent and also submitted a representation to the first respondent. Based on her complaint, a case in Crime No.226 of 2015 was registered on the file of Ramji Nagar Police station, Tiruchirapalli District. However, before the police could find out the place wherein Amarnathan was either hiding or was kept in custody by the others, he himself came back and reported before the second respondent and gave a typed statement on 16.11.2015. https://hcservices.ecourts.gov.in/hcservices/ 3.According to the statement, he was abducted by four named persons for ransom and was let out after getting the money demanded by them. The contents of the said statement are repeated by him before this
Court. From the said statement of Amarnathan, it is now clear that Amarnathan is no longer in the custody of anyone and he is at large and free. Hence there is no need to pass any order directing anybody to set him at liberty as he has already secured his liberty. It is the submission of the learned Additional Public Prosecutor that the police are taking proper steps to proceed with the investigation. Suffice to record the same and close the Habeas Corpus Petition with a direction to the police to investigate the case of abduction for ransom and extortion. 4.The Habeas Corpus Petition is closed accordingly.
