O R D E R

This Criminal Original Petition has been filed seeking a direction to the respondent police to complete the investigation and file final report in FIR in Crime No.255/2013.

2.When the matter is taken up for hearing, the learned Government Advocate (Crl.Side) submitted that based on the complaint lodged by the petitioner, an FIR in crime No. 255 of 2013 had been registered, for the offences under Sections 420, 406 and 506(ii) of IPC. After investigation, the case has been closed as action dropped and to that effect a report has been filed before the learned Judicial Magistrate, Nagercoil. Therefore, nothing survives for further adjudication in this case.

3.In reply, the learned Counsel for the petitioner would submit that no proper investigation has been conducted and no notice was served to the petitioner so far in respect of the closure report. 2/4

4.Since the respondent police have already completed the investigation and filed a report before the learned Judicial Magistrate, Nagercoil, as action dropped in the year 2014, it is for the petitioner to approach the concerned Judicial Magistrate in the manner known to law. 5.Recording the said submission, this criminal original petition is closed.
