ORDER : The Court Made the following order :- Petitioner, prays for grant of anticipatory bail under Section 438 of Cr.P.C. for the offences punishable under Sections 420, 468 and 471 IPC on the file of the respondent police.

2. The case of the prosecution is that petitioner and his brothers falsely created power of attorney and sold the property.

3. Learned counsel for petitioner submitted that in a dispute between family members, petitioner who is the power of attorney of some of them stands falsely arrayed as accused.

4. Learned counsel for defacto complainant referring to typed set filed in Crl.M.P.(MD) No.16727 of 2016 submitted that a false legal heir certificate and also other documents have been created.

5. On consideration of the facts and circumstances of the case and the submissions made, particularly giving the position that the truth or otherwise of the accusation would be bourn out by records, this Court is of the view that the petitioner can be granted the relief prayed for and accordingly;

(a) Interim anticipatory bail already granted on 07.09.2016 is made absolute.

(b) Petitioner shall cooperate for investigation. (c) Petitioner shall be available for interrogation by the respondent police daily at 10.30 a.m. for two weeks and thereafter as and when required.
