ORDER : The Court Made the following order :- Petitioner, prays for grant of anticipatory bail under Section 438 of Cr.P.C. for the offences punishable under Sections 468, 471 and 420 IPC in Crime No.17 of 2016 on the file of the respondent police.

2. The case of the prosecution is that petitioner created forged documents and tried to construct a house in the property of the petitioner.

3. Learned counsel for petitioners submits that the property under dispute, in respect of which alleged false document has been created, is actually Government assigned lands. He would further submit that the property in dispute has been purchased by the intervenor/defacto complainant from the petitioner.

4. Learned counsel for intervenor informs that the comparison of title deeds and the revenue documents referred to by learned counsel for petitioner would reflect the position both relate to the property of intervenor.

5. On consideration of the facts and circumstances of the case and the submissions made, particularly giving the position that the truth or otherwise of the accusation would be bourn out by records, this Court is of the view that the petitioners can be granted the relief prayed for and accordingly;

(a) Interim anticipatory bail already granted on 07.09.2016 is made absolute.

(b) Petitioner shall cooperate for investigation. (c) Petitioner shall be available for interrogation by the respondent police as and when required.
