ORDER
Seeking to afford necessary police protection to conclude the survey in 2 Acres and 37 Cents in S.No.88/7, 88/9, 91/4, 91/9, 91/12, 91/8(1) in Mathagiri Village, Kadavur Taluk, Karur District, this criminal original petition is filed.
2. Since no adverse order is passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.

The learned counsel for the petitioner submitted that the petitioner is the absolute owner in possession of the property mentioned supra by the strength of registered sale deed in Document No.559/1990 dated 09.07.1990. After purchasing the said property, in order to fix the boundaries, the petitioner had paid necessary fee to the Surveyor and even thereafter made a representation on 20.08.2025 to conduct survey. Since the same was not conducted by the revenue authorities, the 2/6
petitioner had filed a writ petition in W.P(MD)No.35840 of 2025 seeking to direct the Tahsildar and Head Surveyor to demarcate the petitioner's land comprised in Survey No.88/7 and 88/9 and the said writ petition was disposed on 15.12.2025 directing the revenue authorities to consider the petitioner's representation dated 20.08.2025 and provide reasonable opportunity of enquiry to the petitioner and other persons and take necessary steps. In this regard, the revenue authorities had fixed the date for surveying the land on 20.01.2026. Notice was also served to all necessary parties including the rival parties and the petitioner by the Surveyor. Further, on 22.01.2026, the Surveyor had conducted a survey in the said land in the presence of adjacent land owners with the police protection and survey stones were also laid marking the boundaries of the petitioner and separate FMB was produced by the revenue authorities. Thereafter, the 3rd respondent hindering the petitioner from putting up fence. Hence, this petition. 3/6
4. The learned Government Advocate(Crl.Side) submitted that the 3rd respondent had filed W.P(MD)No.5069 of 2026 for surveying the property and the same was allowed on 25.02.2026.
5. Heard the learned counsel on either side and carefully perused the materials available on record.

Since it is brought to the notice of this Court by the learned Government Advocate(Crl.Side) that the 3rd respondent had obtained an order to survey the land, the petitioner is directed to co-operate with the said survey in terms of the order passed by this Court in W.P(MD)No. 5069 of 2026 and thereafter, proceed to put up the boundary stones on conclusion of the survey by the revenue authorities as directed by this Court in W.P(MD)No.5069 of 2026. The 2nd respondent police is directed to afford necessary police protection in terms of the boundaries fixed by the revenue authorities, on payment of necessary fees in terms of G.O(Ms)No.139, Home (Pol-VIII) Department, dated 04.03.2019. 4/6
7. With the above directions, this Criminal Original Petition is disposed of.
