PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the 1st respondent to Execute the warrant in Crl.M.P.No.221/2020 in M.C.No.83 of 2017 Issued by earned Family Court Ramanthapuram Dated 04.05.2021 and proceed with the same in acordance with law within the time stipulated by this Honourable Court.

ORDER

This petition has been filed for direction directing the first respondent to execute the warrant issued as against the second respondent in Crl.M.P. No.221 of 2020 in MC No.83 of 2017 on the file of the Family Court, Ramanathapuram dated 04.05.2021.

2. The petitioner is the wife. The second respondent is the husband. The petitioner was driven out from the matrimonial home and as such she is maintaining herself, therefore she has filed a maintenance case in MC No.83 of 2017 and the Court below vide order dated 20.03.2018 ordered monthly maintenance of Rs. 3500/- payable by the second respondent in favour of the petitioner herein. However the second respondent failed to pay the monthly maintenance, as such the petitioner has filed petition in Crl.M.P.No.221 of 2020 in MC No.83 of 2017 for execution of the said order. On receipt of the same, notice was ordered and the second respondent failed to appear before the Family Court and as such the Family Court issued Bailable Warrant against him and the same is pending.

Considering the above, the first respondent is directed to instruct the concerned jurisdictional police officer to execute the bailable warrant issued as against the second respondent in Crl.M.P.No.221 of 2020 in MC No.83 of 2017 within a period of four https://hcservices.ecourts.gov.in/hcservices/

weeks from the date of receipt of a copy of this order. Further the petitioner is also directed to co-operate while executing the bailable warrant as against the second respondent by furnishing correct address of the second respondent.

4. With the above direction, the Criminal Original Petition stands disposed of.
