ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.G.Aravinthan Advocate for the Petitioner and of Mrs.M.Aasha , Government Advocate for the respondent, this Court made the following order:

"This Criminal Miscellaneous Petition has been filed seeking orders to modify the condition directing the petitioner to surrender and execute the sureties before the Principal District and Sessions Court, Nagercoil by order, dated 08.08.2024 in Crl.M.P(MD) No.7949 of 2024 in Crl.M.P(MD)No.12641 of 2023 in Crl.RC(MD)No.388 of 2020 on the file of this Court. 2.The learned counsel for the petitioner would submit that the petitioner has filed a petition in Crl.MP(MD)No.7949 of 2024, seeking extension of time to comply with the modified conditions imposed in Crl.MP(MD)No.12639 of 2023, dated 12.10.2023 and the prayer claimed in the petition is extracted hereunder : "The Criminal Miscellaneous Petition filed under Section 528 of BNSS., to extend the time imposed in Crl.M.P(MD)No.12639 of 2023 in Crl.RC(MD)No.388 of 2020, dated 12.10.2023 in Crime No.6 of 2020 and permit the petitioner to surrender and execute sureties before the learned Principal District and Sessions Court, Nagercoil." 2/4

3.This Court, Considering the submissions made on either side, has allowed the said petition and extended time by ten days from the date of receipt of copy of the said order. It is pertinent to mention that in the order copy, prayer sought for by the petitioner has been incorporated. But in the original as well as the modified order, there was no direction for any surrender and this Court has extended time for production of sureties.
