ORDER
This writ petition has been filed to quash the impugned order in C.No.93/Tapal/DCB II/DGL/2025 dated 12.12.2025 passed by the 2nd respondent and consequently direct the respondents 1 & 2 take appropriate action based on the petitioner's representation dated 05.12.2025.
2. Admittedly, there was a civil dispute between the petitioner's grandfather and the proposed accused's grandfather, which culminated in the filing of a suit in O.S. No. 1480 of 1990 on the file of the Principal District Munsif Court, Dindigul. The said suit was filed for declaration and permanent injunction, and subsequently, the petitioner took delivery of possession through execution proceedings. In spite of the same, the proposed respondents have executed a partition deed including Survey No. 328/2-C.
3. The learned counsel appearing for the petitioner submitted that the proposed respondents are also in possession of adjacent land. However, they have included the petitioner's land in the partition deed, thereby attempting to usurp the petitioner's property.
4. Accordingly, the impugned order dated 12.12.2025 is quashed. Therefore, the official respondents are directed to re-enquire into the matter and take appropriate action in accordance with law.

5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
