PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.2053 of 2021 on the file of the second respondent police.
ORDER : The Court made the following order :- The petitioners/A.1 to A.3, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 498A, 313, 309, 109 and 406 IPC, in Crime No.2053 of 2021 on the file of the second respondent police, seek anticipatory bail.
2. The case of the prosecution is that the first petitioner and the defacto complainant are husband and wife and that the petitioners had demanded more dowry from the defacto complainant's parents and also harassed the defacto complainant, due to that, the defacto complainant consumed rat poison and admitted in the hospital. Hence, the complaint.
3. The learned counsel for the third respondent would submit that this Court while dismissing the petition in Crl.O.P.(MD)no.4669 of 2022, which was filed to quash the FIR in Crime no.2053 of 2021, directed the second respondent to file a final report within a period of 12 weeks from the date of receipt of a copy of that order.
4. When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondents 1 and 2 would submit that the defacto complainant has appeared before the police and gave in writing that no further action is necessary and on recording the same, the action was ordered to be dropped and he has also filed a copy of the report filed by the Special SubInspector of Police, All Women Police Station, Tallakulam.
