SIDE) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.8 to 10, pray for the grant of anticipatory bail under Section 438 of Cr.P.C. for the alleged offences punishable under Sections 406, 420 r/w Sec. 120(b) I.P.C and Sections 4 and 5 of the Prize Chits and Money Circulation Schemes (Banning) Act, 1978, in Crime No.04 of 2014 on the file of the respondent police.
2. Learned senior counsel for petitioners submitted that a charge sheet stands filed in the case and therein, the position that petitioners had resigned from Directorship of the first accused company much before the offending transactions is admitted. The involvement of petitioners is informed on the allegation that the other accused continue to work for the financial establishment. Learned senior counsel further submitted that the Special Court has issued summons afresh to these petitioners.
3. Heard learned Government Advocate (Crl.Side).
4. Considering the above submissions and also considering the fact that upon completion of investigation, a charge sheet stands filed in the case, this Court is of the view that the petitioners can be granted the relief prayed for and accordingly;
(a) In the event of arrest by or on appearance before the respondent police;
(b) In the event of appearance before the learned Special Judge, https://hcservices.ecourts.gov.in/hcservices/
TNPID Cases, Madurai, within 15 days from the date of receipt of this order, (i) the petitioners shall be enlarged on bail on each of them executing a bond in a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for the like sum to their satisfaction; (ii) the petitioners shall appear before the trial court on all hearing dates, except their presence is dispensed with under Section 317 Cr.P.C.
