O R D E R
This Writ Petition has been filed seeking a direction to the respondents herein to disburse and pay all the monetary benefits of the petitioner's deceased mother Ananthi, who died on 09.10.2019 while serving as Pharmacist in the Office of the fourth respondent government Hospital, Panaikulam, Ramanathapuram District, by considering the petitioner's representation dated 17.02.2025.
2. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.
3. The case of the petitioner is that he is the son of one V.Anandhi,
who died on 09.10.2019 ehile working as Pharmacist in the Primary Health Centre at Eravadi, Ramanathapuram District. The petitioner sent a representation to the respondents to sanction and disburse all the death benefits of his mother to him.
4. The learned counsel for the petitioner submits that in the service records of her mother by mistake one V.Anandha Krishnan's name is mentioned as nominee. His grand-father gave no objection affidavit to give all death benefits to him. In that regard, the petitioner submitted a representation to the respondents on 17.02.2025. Aggrieved by the inaction of the respondents in considering the said representation, the petitioner filed this writ petition.
5. Mr.Vinoth, learned Government Advocate, on instructions, submits that the name of one Anandha Krishnan is entered as nominee in the service register of the deceased employee i.e V.Anandhi. Due to that reason, the respondents could not consider the request of the petiitoner.
6. Considering the facts and circumstances of the case, in the considered opinion of this Court, it is appropriate and reasonable to dispose of this writ petition without going into merits of the case at this stage with a direction to the third respondent to consider the representation dated 17.02.2025 of the petitioner and pass appropriate orders in accordance with law within a stipulated time.
7. Accordingly, this writ petition is disposed of with a direction to the third respondent to consider the representation dated 17.02.2025 of the petitioner and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of a copy of this order and communicate the same to the petitioner.
There shall be no order as to costs.
