ORDER : The Court Made the following order :- The petitioner / Accused No.3, who was arrested and remanded to Judicial custody on 05.03.2018 for the offences punishable under Section 302 of I.P.C, in Crime No.70 of 2018, on the file of the respondent police seeks bail.

2.The case of the prosecution is that the petitioner and other accused have committed murder of the deceased.

3. On the side of the petitioner it is stated that there is no eye witness and that the petitioner is innocent and that coaccused have been released on bail and that petitioner is in custody from 05.03.2018 and hence, prayed that the petitioner to be released on bail.

4.On the side of the respondent, it is stated that four accused are involved in a pre-planned murder . A1 and A2 having illegal intimacy. A2 is the wife of the deceased, who colluded with other accused had committed the murder. On the basis of the confession of the co- accused, this petitioner has been implicated as an accused and that the investigation is still pending. Hence, he objected to release of the petitioner on bail.

5.Considering the facts and circumstances of the case and considering the fact that the allegation against the petitioner is murder which is grievous in nature and that the petitioner is in custody only from 05.03.2018 and the investigation is still pending, this Court is not inclined to grant bail to the petitioner.
