O R D E R
*********** [Order of the Court was made by P.R.SHIVAKUMAR, J.] The alleged detenu - Mrs.Laila Nazreen Farzana, on her own accord, has come to this Court, after having received information regarding the filing of the present Habeas Corpus Petition by her father and the date of hearing. The petitioner is none other than the father of Mrs.Laila Nazreen Farzana. Her husband, by name, Seeni Ahamed Sadhik, filed an earlier petition as H.C.P.(MD). No.1653 of 2015 for the production of the very same person and the same was dismissed as withdrawn on 27.11.2015, since he was advised that he could approach the appropriate Court for necessary matrimonial relief. than the father of Mrs.Laila Nazreen Farzana, trading wild allegations against her husband and expressing apprehension that she would have been illegally confined by her husband, has come forward with the present Habeas Corpus Petition.
2. Be that as it may, today, Mrs.Laila Nazreen Farzana herself has chosen to appear before this Court. She states that due to difference of opinion, she parted with her husband on 19.11.2015 and was residing in Thandaiyarpettai, Chennai in the house of her relative. It is her further statement that subsequently she came down to Madurai and she is now in the residence of her elder sister - Aaiysa Kani in Vandiyoor, Madurai. It is her further statement that when she contacted with her father, namely, the petitioner herein, over phone, he informed her of the pendency of the present Habeas Corpus Petition and the date of hearing, pursuant to which she has come to this Court. She further states that she is not in the custody of anyone and she, on her own volition, is residing in Vandiyoor, Madurai with her elder sister - Aaiysa Kani.
3. The said statement shows that no case of either abduction or detention has been made out. Mrs.Laila Nazreen Farzana, being a major, has taken her own decision to leave her husband and to be with her elder sister. As such, nothing remains to be adjudicated in this Habeas Corpus Petition, excepting recording the said statement. Accordingly, the statement of Mrs.Laila Nazreen Farzana is recorded and the Habeas Corpus Petition is disposed of holding that she is not in the custody of anyone and she is a free bird.
