ORDER
The present petition has been filed by A1, A2 and A4 seeking to quash the charge sheet in C.C.No.1290 of 2025 on the file of the learned Judicial 1/4
Magistrate No.II, Ramanathapuram District, insofar as the petitioners are concerned, wherein the petitioners have been charged for the offences under Sections 120B, 465, 468, 471 and 420 of IPC.
2.As per the case of the prosecution, the father of the defacto complainant, namely, Muruganantham has executed a power deed in favour of A1 on 20.08.2001 and thereafter he had passed away on 27.01.2010. Suppressing the death of the said Muruganantham, the first accused is said to have used the power deed and sold the property in favour of A2 on 23.04.2010. Thereafter, the property has been sold in favour of A4. 3.Heard both sides and perused the material records. 4.A perusal of the charge sheet reveals that the prima facie has been made out as against the petitioners and therefore, this Court is not inclined to interfere at this stage especially when no legal grounds have been raised for quashing the charge sheet.
5.The trial Court is directed to dispose of the case on merits without being influenced by any one of the observations made by this Court. 2/4
Considering the age of the first petitioner, the personal appearance of the first petitioner herein is dispensed with unless specifically directed by the trial Court.
6.With the above said observations, this Criminal Original Petition stands dismissed. Consequently, the connected Crl.M.P.(MD).No.5491 of 2026 is ordered in respect of the first petitioner alone and Crl.M.P.(MD).No.5488 of 2026 is closed.
