ORDER
The present petition has been filed by the sole accused in S.C.No.421 of 2025 on the file of the District and Sessions Court(Mahila), Madurai, seeking to quash the charge sheet.
2. As per the case of the prosecution, the petitioner is a Driver-cumConductor of the State Express Transport Corporation and he is said to have misbehaved with the second respondent who is a lady passenger while driving the vehicle.
3. According to the learned Counsel appearing for the petitioner, there is no allegation whatsoever with regard to the advances involving unwelcome and explicit sexual overtures as contemplated under Section 75(1)(i) of BNSS, 2023.
4. This Court is of the considered opinion that prima facie there is some materials as against the petitioner for filing the charge sheet. In such circumstances, this Court does not like to express any opinion about the merits of the case which may affect the trial.

5. With the above said observations, this Criminal Original Petition stands dismissed. However, the presence of the petitioner shall be dispensed with by the trial Court unless it is specifically called for them.
