ORDER

It is an application seeking a direction to the respondent police not to harass the petitioners under the guise of enquiry. 2.Heard the learned counsel for the petitioners and the learned Government Advocate (Crl. Side) for the respondent.

3. The learned counsel for the petitioner would submit that the petitioners are husband and wife and they are being harassed by the respondent, based on the complaint of one Tamilselvi.

4. Per contra, the learned Government Advocate (Criminal Side) would submit that the said Tamilselvi lodged a complaint alleging that the petitioners have committed mis-appropriation of 3 1⁄2 sovereigns of gold jewels. So, the respondent police call the petitioners for enquiry and they have not harassed the petitioners. However, he gave an undertaking that if at all the presence of the petitioners is required, the respondent would call the petitioners for enquiry only after issuing summons giving specific date, time and place.

5.Recording the above undertaking given by the learned Government Advocate (Crl. Side), this petition is closed. However, the respondent police shall not harass the petitioners under the guise of enquiry.
