ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 364, 302 IPC @ U/s.364, 302 and 120-B IPC, in Crime No. 125 of 2016, on the file of the respondent police, seek anticipatory bail.
2. The Case of the prosecution is that due to previous motive on 20.04.2016, the accused persons entered into the criminal conspiracy and abducted the deceased Packiyaraj and attacked him with aruval and caused death and thereby the accused committed the offences mentioned above.
3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case.
4. The learned Government Advocate (Criminal Side) submitted that the petitioner is arrayed as A7, who is none other than the brother of one Janaki, who is having illegal intimacy with A1. He further submitted that charge sheet has has already filed on https://hcservices.ecourts.gov.in/hcservices/
21.07.2016 and it is yet to be taken cognizance by the competent Court.
5.Considering the facts and circumstances of the case and also considering the overt act attributed against the petitioner, I am inclined to grant anticipatory bail to the petitioner with the following condition. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.III, Tirunelveli, within a period of 10 days from the date on which the order copy made ready, and on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the Trial Court daily at 10. a.m. until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.
