Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the Principal District Munsif cum Judicial Magistrate, Tuticorin to expedite the proceedings in C.C.No.76 of 2017 and to dispose it on merits within the time frame that may be fixed by this Court.

ORDER

The present petition is filed seeking a direction to the concerned Magistrate to expedite the proceedings in C.C.No.76 of 2017 and to dispose it on merits within the time frame that may be stipulated by this Court.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. 3.The grievance of the petitioner is that even though the case has been filed in the year 2017, some of the accused persons are deliberately dragging on the proceedings and hence, the petitioner has filed the present petition.

4. Considering the fact that the case is of the year 2017, this Court is inclined to issue a direction for expeditious disposal. Though the direction is sought to be given to the Principal District https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.5285 of 2021 Munsif cum Judicial Magistrate, Tuticorin, the case in C.C.No.76 of 2017 is originally pending before the Judicial Magistrate No.1, Tuticorin. Hence, the learned Judicial Magistrate No.1, Tuticorin is directed to expedite the trial and conclude the same within a period of 6 months from the date of receipt of a copy of this order. The learned Judicial Magistrate No.1, Tuticorin, shall send a compliance report to this Court, after the disposal.
