Respondents PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C. praying to direct the 1st respondent to instruct the 2nd respondent to hand over the investigation to the 3rd respondent or the investigation may be directed to be entrusted to any other competent Police Officer under the supervision of the 1st respondent to investigate the same in Crime No.186 of 2016 on the file of the 2nd respondent and to file final report within the time frame that may be stipulated by this Court.

ORDER

This petition is filed to transfer the case in Crime No.186 of 2016 from the file of the 2nd respondent to 3rd respondent.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) for the respondents.

3. The learned Government Advocate (Crl. Side), on instructions would submit that the 2nd respondent after conducting proper investigation in Crime No.186 of 2016, closed the case as mistake of fact.

4. Recording the above submission, this Criminal Original

Petition is dismissed. However, the second respondent is directed to furnish a copy of the closure report to the counsel for the petitioner, if not furnished already and on receipt of the same, it is open to the petitioner to work out his remedy in the manner known to law.
