ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under section 379 of I.P.C. and Section 21(4) of the Mines and Minerals (Development and Regulation) Act, in Crime No.474 of 2020, on the file of the respondent police, seeks anticipatory bail.

2.Heard both sides.

3.The petitioner herein has illegally mined 1⁄4 unit of river sand and loaded it in his bullock cart. On seeing the respondent police he has abandoned the bullock cart and has fleded. Now, he is before this Court seeking anticipatory bail. The occurrence is on 08.05.2020, during the lock down period.

CRL OP(MD). No.5450 of 2020 4.The learned Additional Public Prosecutor appearing for the State submits that taking advantage of lock down, the petitioner herein tried to illegally mine 1⁄4 unit of river sand, which was intercepted by the respondent police. If the petitioner is granted anticipatory bail, he will again indulge in similar offence. 5.Recording the same, this Criminal Original Petition stands dismissed.
