ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, was were arrested and remanded to judicial custody on 08.08.2016 for the alleged offences punishable under Sections 366(A) of IPC, in Crime No.45 of 2016, on the file of the respondent police and hence, seeks bail.
2.The prosecution case is that on 13.07.2016 the daughter of the defacto complainant was kidnapped by the accused. 3.Mr.C.D.Johnson, learned counsel appearing for the petitioner would submit that this is a case of love affair and the alleged victim on her own volition joined with petitioner on 13.07.2016. It is further submitted that she joined at Amirtha Hotel Management and Catering Technology and she also was staying in the hostel. The love affair is not acceptable by the defacto complainant and therefore, the petitioner has been falsely implicated in this case.
4.The learned Government Advocate (Crl.side) would submit that the defacto complaint filed H.C.P.(MD)No.962 of 2016 before this Court and the girl was produced on 09.08.2016 and on that day, she gave a statement stating that she is not interested to go with her parents and she is now in Sakthi Videal Home. 5.Considering the facts of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two https://hcservices.ecourts.gov.in/hcservices/
sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruppathur and on further condition that the petitioner shall stay at Batlagundu and appear before the Thandikudi police Station daily at 10.00 a.m., until further orders.
