PRAYER :- Writ Petition filed under Article 226 of Constitution of India, praying this Court to issue of Writ of Mandamus directing the respondents to rectify and remove the mistake crept in the Revenue Records, as Tamil Nadu Boothan Board and incorporate the petitioner's name pertaining to the lands morefully described in the scheduled contained in the petition, and grant the patta for the said properties in favour of the petitioner or in the alternative direct the fourth respondent to consider and dispose of the representation dated 22-08-2019. ORDER

The writ petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents to rectify and remove the mistake crept in the Revenue Records, as Tamil Nadu Boothan Board and to incorporate the petitioner's name pertaining to the lands morefully described in the schedule contained in the petition, and to grant patta for the said properties in favour of the petitioner or in the alternative, to direct the fourth respondent to consider and dispose of his representation dated 22.08.2019.

The learned counsel appearing for the petitioner would submit that the properties in Survey Nos.90/4, 91/4 and 451/A2 situated in Kelavikkramam Village are owned by the petitioner and his family members. The petitioner's father, S.Somaiya Nattar, was initially administering and maintaining the aforesaid properties as well as the other family properties and he expired on 01.06.1988. Thereafter, the petitioner's family members continued to maintain the properties, while the petitioner was away from his native place due to work. He would further submit that recently, upon verification of the revenue records, the petitioner was surprised to note that the aforesaid properties are stated to have been gifted by the petitioner's father to Tamil Nadu Boothan Board in the year 1985.

However, the petitioner's father has not donated any such lands to anyone during his lifetime. Hence, the petitioner submitted a representation dated 22.08.2019 seeking rectification of the mistake by removing the Tamil Nadu Boothan Board from the revenue records relating to the aforesaid lands. However, no action has been taken till date and therefore, the petitioner has filed the present writ petition. 3.

would submit that the petitioner's representation will be considered and appropriate orders will be passed in accordance with law, within a time frame to be fixed by this Court.

4.Recording the above submissions, this Writ Petition is disposed of, with a direction to the fourth respondent to consider the representation of the petitioner, dated 22.08.2019, on merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner and all other persons, who may be interested in the subject matter, within a period of eight weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the fourth respondent to consider the same on its own merits. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
