JUDGMENT

This Second Appeal is filed to set aside the judgment and decree dated 31.01.2014 made in A.S.No.23 of 2012 on the file of Principal Sub Court, Kumbakonam, confirming the judgment and decree dated 30.03.2012 made in O.S.No.100 of 2009 on the file of District Munsif Cum Judicial Magistrate, Papanasam.

2.Respondent side ready for arguments. Even after giving sufficient opportunity, appellant is not ready for arguments. The Second Appeal is pending from the year 2014. Original Suit was filed in the year 2009.

3.Even after giving so many adjournments, the appellant is not ready to argue the case. Even today, ie, on 22.10.2018, there was no representation on the side of the appellant. There is no use in keeping this case further.

4.A perusal of the records reveals that this Second Appeal is filed against the concurrent findings of both the lower courts. There is no substantial question of law to be decided in this case. Hence, this Second Appeal is dismissed on merits. Consequently, connected miscellaneous petition is also dismissed.
