O R D E R

The petition has been filed seeing a direction to the respondents not to harass the petitioners based on the complaint submitted by the defacto complainant under the guise of enquiry. 2.Mr.K.Manikandan, learned counsel appearing for the petitioners would submit that in respect of the civil dispute, the petitioners 1 and 2 have instituted a suit in O.S.No.111 of 2015 against the defacto complainant and the case is pending before the District Munsif Court, Theni. But the second respondent under the guise of enquiry, in connection with the complaint given by the defacto complainant, insisting the petitioners to deliver the property in question to the defacto complainant. He would further submit that they have been falsely implicated in this case and unnecessarily harassed by the respondent police. https://hcservices.ecourts.gov.in/hcservices/

3.Per contra, the learned Government Advocate (crl.side) would submit that based on the complaint, the respondent police are investigating the case and there is no such harassment. 4.Recording the submission made by the learned Government Advocate (Crl. Side), the respondent police is at liberty to conduct the enquiry, but shall not harass the petitioners. 5.Accordingly, this Criminal Original Petition is disposed of.
