DECREE:

This Second Appeal coming on for hearing on this day. Upon perusing the Grounds of Appeal, the Judgement and Decrees of the Lower Appellate court and the court of First instance and the material papers in the suit and upon hearing the arguments of Mr.S.Rajaprabhu Advocate for the Appellant and Mr.V.Meenakshi Sundaram for Mr.D.Nallathambi, Advocate for the Respondent doth order and decree as follows:

1. That the Judgment and decreetal order dated 30.01.2014 Passed by the I Additional Subordinate Court in A.S.No.89 of 2011, reversing the Judgment and decreetal order dated 12.09.2011 passed by the III Additional District Munsif Court, Nagercoil in O.S.No.351 of 2010 be and are hereby confirmed and this Second Appeal is hereby dismissed.
