ORDER : The Court Made the following order :- The petitioner, who is arrayed arrayed as sole accused, was arrested and remanded to judicial custody on 19.07.2016 for the alleged offences punishable under Sections 3(a) and 4 of the Protection of Children from Sexual Offences Act, 2012, in Crime No.6 of 2016, on the file of the respondent Police and hence, seeks bail.
2. The case of the prosecution is that the petitioner had committed sexual offence against the daughter of the defacto complainant.
3. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents.
4.The learned counsel for the petitioner submitted that due to property dispute, a false case has been foisted against the petitioner. He further submitted that the petitioner is 80 years old and he is chronics diabetic patient and he is unable to walk without his stick and he is innocent and he has not committed any offence as alleged by the prosecution.

6.Considering the fact that the petitioner is senior citizen, aged about 80 years and that he is in judicial custody from 19.07.2016, this Court is inclined to release the petitioner on bail. Accordingly, the petitioner is ordered to be released on bail on his executing a bond in a sum of Rs.10,000/-(Rupees Ten thousand only) with two sureties each for the like sum to the satisfaction of learned (*) Additional District Court, (Mahila Court) Pudukottai and on condition that the petitioner shall appear before the concerned Court daily at 10.30 am until further orders. sd/- 19/09/2016 (*)Amended as per order of this Hon'ble Court made in CRL MP(MD).No. 9411/2016 in Crl.O.P.(MD)No. 16930/16 dated 30.09.2016 / TRUE COPY / Sd/- 30/09/2016 Sub-Assistant Registrar (C.S.)
