Petitioner PRAYER : Transfer Civil Miscellaneous Petition is filed under Section 24 of Code of Civil Procedure, to withdraw the H.M.O.P.No.199 of 2022 on the file of the Principal subordinate Judge, Dindigul and to transfer the same to the Family Court, Madurai for further proceedings. ORDER

The present transfer civil miscellaneous petition has been filed to transfer H.M.O.P.No.199 of 2022 from the file of the Principal subordinate Judge, Dindigul to the file of the Family Court, Madurai.

2. It is informed that the petitioner has already filed H.M.O.P.No. 837 of 2020 before the Family Court, Madurai for restitution of conjugal rights.

3. The learned counsel for the respondent, on instructions, submits that the respondent has no objections for allowing the present transfer civil miscellaneous petition. He further prayed for dispensing with the personal appearance of the respondent for regular hearing except the respondent is required by the Court.

4. Recording the said submission, the present Transfer Civil Miscellaneous Petition stands allowed by transferring H.M.O.P.No.199 of 2022 from the file of the Principal subordinate Judge, Dindigul to the file of the Family Court, Madurai. Consequently, H.M.O.P.No.199 of 2/4

2022 shall be tried along with H.M.O.P.No.837 of 2020, which is pending before the Family Court, Madurai. The personal appearance of the respondent stands dispensed with. However, as and when the Court directs that the respondent to appear before the Court, he shall appear. No costs.
