ORDER

The Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to conduct enquiry and dispose the same by

considering the representation made by the petitioner dated 22.09.2025 within the time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the second respondent, notice to the second respondent is hereby dispensed with.

4. The learned counsel for the petitioner would submit that the subject property originally belonged to the petitioner's father and after his demise, during the UDR survey, the property was wrongly classified as Government Punja Land. Subsequently, assignment Patta was issued in favour of the second respondent, vide proceedings dated 31.12.1993. The second respondent, suppressing the material facts, illegally obtained the assignment Patta in respect of the petitioner's father's property and executed a sale deed in respect of third parties. Hence, the petitioner submitted a detailed representation dated 22.09.2025 to the first respondent seeking to cancel the assignment Patta. Despite the same, no enquiry

has been conducted nor any action has been taken till date. Hence, the present Writ Petition.

5. The learned Special Government Advocate appearing for the first respondent submits that the first respondent requires sixteen weeks' time to conduct an enquiry and pass appropriate orders in accordance with law.

Recording the above submissions, this Writ Petition is disposed of, with a direction to the first respondent to conduct an enquiry and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner, the second respondent and all other persons, who may be interested in the subject matter, within a period of sixteen weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the first respondent to pass appropriate orders on merits and in accordance with law. There shall be no order as to costs.
