ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1, was arrested and remanded to judicial custody on 28.06.2016 for the alleged offences punishable under Sections 147, 148, 324, 302, 506(ii) and 307 of IPC, in Crime No.400 of 2016, on the file of the respondent police and hence, seeks bail.
2.The case of the prosecution is that on 27.06.2016 at about 05.00 p.m., due to wordy quarrel, the petitioner said to have attacked the deceased with aruval and caused fatal injuries. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has not committed any offence as alleged by the respondent and it is further submitted that totally there are five accused in this case and all were secured by the respondent on 28.06.2016. Except this petitioner, other accused were granted bail and prays for anticipatory bail in favour of the petitioner.
4.The learned Government Advocate (Crl.side) would submit that major part of the investigation is over and the petitioner is not having any previous case.
5.Considering the nature of allegations, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) https://hcservices.ecourts.gov.in/hcservices/
with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Trichy and on further condition that the petitioner shall appear before the respondent police daily twice at 10.00 a.m., and 5.00 p.m., until further orders. sd/- 09/09/2016 / TRUE COPY / Sub-Assistant Registrar (C.S.)
