DECREE:This Appeal coming on for hearing on this day, Upon perusing the grounds of Appeal, the order of the Lower Court and the material papers in the Appeal and upon hearing the arguments of Mr.PT.S.Narendra Vasan, Advocate for the Appellant and Mr.K.Guhan, Advocate for the Respondents, this Court while dismissing the Second Appeal, doth order and decree as follows: (i)that the Judgment and Decree of the Sub Court, Uthamapalayam, dated 18.12.2013, made in A.S.No.42 of 2011 confirming the judgment and decree of the District Munsif Court, Uthamapalayam dated 23.09.2011 made in O.S.No.119 of 2010 be and hereby are confirmed and the Second Appeal is Dismissed and (ii)that there be no costs in the Second Appeal.
