For Respondent : Mr.S.Chandarasekar, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 171 of 2020 on the respondent police.
ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. 2.The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 399 and 402 of I.P.C., in Crime No.171 of 2020, on the file of the respondent police, seeks anticipatory bail.
3.As per the First Information Report, this petitioner along with four others were found in possession of deadly weapons and prepared https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD). No.5484 of 2020 for dacoity. On seeing the patrol party, they tried to fled. The police were able to apprehend A2 and A5 and recorded their statements. From their statements, they came to know about the involvement of this petitioner in the preparation for committing dacoity.
4.The learned Additional Public Prosecutor appearing for the State seriously opposed to grant anticipatory bail to the petitioner on the ground that the petitioner is having very bad antecedents and nearly 27 cases are pending against him. Pending trial all these cases, he is continuously engaging himself in unlawful activities. Based on the confession statement given by the arrested accused, this petitioner has been arrayed as prime accused and the respondent police are in search of him.
