ORDER

The present writ petition has been filed seeking to direct the respondents 1 to 3 to take action on petitioner's complaint, dated 04.03.2025 and grant police protection for worshipping the Arulmigu Poorana Pushkala, Ayyanar and Pethana Swamy Temple situated at Ilambhuvanam Village, Ettayapuram Taluk, Thoothukudi District.

2. According to the petitioner, he is one of the devotee of Ayyanar and Pethana Swamy. The 4th respondent attempted to install a statue of Pethana Swamy and decided to conduct Kumbhabishegam on 09.03.2025. In this regard, the petitioner has sent a representation to the 2/6

1st respondent in person and through online portal, but the same were not considered. Hence, this petition.

3.The learned counsel for the 4th respondent would submit that they have already constructed the temple and decided to conduct Kumbhabishegam on 09.03.2025. Now, the petitioner is causing obstruction to erect the statue and to conduct Kumbhabishegam. Hence, prays to dismiss the petition.

4.The learned Government Advocate appearing for the 3rd respondent would submit that there is a dispute between the villagers in conducting Kumbhabishegam and majority of the people are supporting the 4th respondent and now the petitioner has filed this petition not to erect statue of Pethana Swamy.

5.The learned Additional Public Prosecutor appearing for the respondents 1 and 2 would submit that the 1st respondent recently received the complaint of the petitioner. So far, the 2nd respondent has not received the complaint. Today, peace committee meeting is going on 3/6

between the parties. Therefore, the petitioner has to approach the authorities based on the resolution passed in the peace committee meeting.

6.This Court had heard both sides and perused the materials available on record.

7.The prayer of the petitioner is to direct the respondents 1 to 3 to take action on the petitioner's complaint dated 04.03.2025 and to grant police protection for worshipping the Arulmigu Poorana Pushkala, Ayyanar and Pethana Swamy Temple situated in Ilambhuvanam Village, Ettayapuram Taluk, Thoothukudi District. Since the peace committee meeting is going on today, the revenue authorities shall take appropriate action in this regard. Further, the petitioner can worship the deity without any restrictions, since the 4th respondent submitted that they have not caused any obstruction for worshipping.

8. With the above said observations and directions, this writ petition stands disposed of. If anybody indulged in criminal activity, then both parties can approach respondent police. Consequently, connected miscellaneous petition is closed.
