DECREE : This Second Appeal coming on for hearing on Thursday the 15th day of November 2016. Upon perusing the Grounds of Appeal, the Judgment and Decree of the Lower Appellate court and the court of First instance and the material papers in the suit and upon hearing the arguments of Mr.A.Arumugam, Advocate for M/S.Ajmal Associates for the Appellant and of Mr.M.Vallingyagam, Senior Counsel for the Respondent and having stood over the consideration until this day, and this Court while dismissing the Second Appeal doth order and decree as follows :

1) that the Judgment and Decree dated 11.07.2014 made in A.S.No.13 of 2014 on the file of the Sub Court, Sankarakovil Conforming the Judgment and Decree dated 22.01.2014 made in O.S.No.45 of 2009 on the file of the Additional District Munsif, Sankarankovil be and hereby in confirmed and the Second Appeal is dismissed, and
