O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent not to draw an overhead transmission line over the petitioner's properties in Survey Nos.1296/2A, 1296/2B, 1305/2B, 1308/1 and 1315/1, all situated in Singathakurichi Revenue Village, Srivaikuntam Revenue Sub-District, Tuticorin Revenue District, pending completion of the enquiry under Section 13 of the Indian Telegraph Act, 1885.

2. Ms. P.B. Ahamed Yasmin Parvin, learned Government Advocate, who accepts notice on behalf of the respondents, on instructions, submitted that the respondents have not drawn any overhead transmission line in the lands belonging to the petitioner. It is further submitted that the overhead transmission line, if any, will be drawn only subject to the outcome of the enquiry pending under Section 13 of the Indian Telegraph Act, 1885. The said submission is placed on record.

3. In light of the submission made by the learned Government Advocate, the apprehension of the petitioner that the respondents are likely to draw 3/5

an overhead transmission line pending completion of the enquiry appears to be unfounded.

4. With the above observations, the Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
