ORDER

Seeking to direct the respondents No.1 and 2 to instruct the 3rd and 4th respondents not to harass the petitioner under the guise of the U/s. 110 Cr.P.C proceedings enquiry pertaining without following due process of law, this criminal original petition is filed.

The learned counsel for the petitioner submitted that the petitioner had already filed W.P.Crl(MD)No.2149 of 2025 seeking to direct the 3rd respondent police to remove his name from the history sheet and the same was disposed, directing the representation of the petitioner to be considered. Even thereafter, without considering his representation to remove his name from history sheet, the 3rd respondent had frequented to the office of the petitioner and had caused continuous 2/6

harassment to him and his family members and hence, sought the indulgence of this Court.

3. Heard the learned counsel on either side and carefully perused the materials available on record.

4. In this regard, the 1st and 2nd respondents are directed to consider the representation of the petitioner in terms of the order passed by this Court in W.P.Crl(MD)No.2149 of 2025 within a period of four

(4) weeks from the date of receipt of copy of this order. However, it is made clear that until his name subsists as a history sheeter, this Court cannot pass any positive direction as against the 3rd respondent that they should not monitor the activities of the petitioner. Due to the incoming elections, for the purpose of maintaining law and order, it is made clear that if any information is received as against the petitioner, the petitioner may be put on summons under Section 64 BNSS by the 3rd respondent police and on receiving the same, the petition is directed to cooperate with the enquiry.

5. With the above directions, this Criminal Original Petition is disposed of.
