Respondents Prayer:- Habeas Corpus Petition is filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus directing the second respondent to produce the person or body of the detenu namely Muthulakshmi, daughter of Murugan, aged 18 years before this Court and set her at liberty and pass such further or other orders. ORDER
(Order of the Court was made by A.SELVAM, J) This Habeas Corpus Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents to produce the detenu by name Muthulakshmi, daughter of the petitioner.
2. It is stated in the petition that the fourth respondent viz., the District Social Welfare Officer, Social Welfare Department, Madurai District has taken custody of the detenu at the time of her marriage. Under the said circumstances, the present petition has been filed. https://hcservices.ecourts.gov.in/hcservices/
3. As per the order passed by this Court, the detenu has been kept in a home.
4. The detenu has been produced and she expressed her willingness to go with the petitioner/mother. Further on the side of the petitioner an undertaking affidavit has been filed to the effect that she is not going to conduct marriage of the detenu before she attains majority. Considering all these things, the detenu is permitted to go with the petitioner and this Habeas Corpus Petition is disposed of accordingly.
