ORDER

It is an application seeking a direction to the learned Assistant Sessions Court, Valliyoor to dispose of the case in S.C.No.559 of 2015 within a stipulated period of time.

2. Mr. S. Ramasamy, learned counsel appearing for the petitioner would submit that the petitioner is implicated as 5th accused in Crime No.199 of 2009 and after investigation, the respondent had already filed charge sheet, which is also taken on file in the year 2015. All the accused have been regularly appearing before the trial Court, but, there is no progress in this case, which causes mental agony and hardship to the petitioner.

3. He would further add that the learned Assistant Sessions Judge posted the case for trial on 08.09.2016 and adjourned the same to 09.03.2017. As per Article 21 of the Constitution of India, the accused is entitled to early disposal of the case.

4. The learned Government Advocate (Crl. Side) on instructions would submit that they will co-operate for early disposal of the case.

5. Considering the above submission, the learned Assistant Sessions Judge, Valliyoor, Thirunelveli District is directed to advance the case and dispose of the same as expeditiously as possible in any event not later than 31st March 2017.

5. With the above direction, the Criminal Original Petition is disposed of.
