Writ Petition is filed under article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents to consider the petitioner's representation dated 26.06.2023 and pass appropriate orders for transfer of revenue records (Property Tax) and mutation of the property comprised in Survey No.191/1A, measuring 31 cents in favour of the petitioner and other legal heirs.

ORDER

The prayer in the writ petition is to direct the respondents to consider the petitioner's representation dated 26.06.2023 and pass appropriate orders for transfer the revenue records and mutation of records in respect of the property comprised in S.No.191/1A, measuring 31 cents in favour of the petitioner and other legal heirs.

2.Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the grievance of the petitioner is that in respect of the property in question originally the same was in the name of the husband of the petitioner, viz., Ooikkattan. He died intestate on 12.11.2004 leaving behind the petitioner and other legal heirs. Therefore, when the representation is made for mutation in the revenue records and with reference to the property tax and other details of the property, the same is yet to be done and in spite of representation, no action has been taken and hence, the petitioner is before this Court.

3.When the matter came up for admission, the learned Additional Government Pleader takes notice on behalf of the respondents would submit that the second respondent will take up the representation and will effect the change as prayed for by the petitioner, if it is otherwise in order.

4.In view of thereof, since it is a simple case of mutation of records on the death of the person who was mentioned in the records, necessary corrections have to be made by the second respondent. As such the writ petition is allowed, the second respondent is requested to take up the petitioner's representation dated 26.06.2023 and pass orders effecting the change in the mutation of records, if the application is in otherwise in order. If there is any difficulty, an opportunity of hearing shall be afforded to the petitioner and the petitioner shall be heard. The aforesaid exercise shall be completed within a period of twelve(12) weeks from the date of receipt of web copy of the order, without waiting for the certified copy of the order. No costs.
