The Criminal Original Petition had been filed seeking to direct the Respondents 2 to 4 not to harass the Petitioner in the guise of enquiry by way of interfering civil dispute between Petitioner and Respondent No.5. 2.The learned Counsel for the Petitioner submitted that the Petitioner was in enjoyment of the property allotted to him by the Madurai Corporation. He had only entered into a sale agreement with the fifth Respondent for Rs.82,00,000/-. The fifth Respondent was unable to mobilise funds to purchase the property. In the meanwhile, the Petitioner had sold the property to a different person. Aggrieved by the same, the fifth Respondent is alleged to have approached the third and fourth Respondents. Based on the complaint of the fifth Respondent, the third and fourth Respondent are harassing the Petitioner. Therefore, the Petitioner seeks a direction against the third and fourth Respondents not to interfere with the civil dispute 2/5

3.The learned Government Advocate (Crl.side) on instructions from the Respondents 1 to 4 submitted that based on the complaint of the fifth Respondent, CSR was registered with the Subramaniapuram Police Station and closed as mistake of fact. In the meanwhile, another complaint had also been registered in CSR with the Anna Nagar Police Station and the same was also closed. In the enquiry conducted by the third and fourth Respondents, the Petitioner and the fifth Respondent appeared and the fifth Respondent also withdrew the complaint on the undertaking given by the Petitioner and the enquiry was also closed.
