... Respondents/Respondents Prayer in WMP:- To extent the time to comply the conditional order passed by this Hon'ble Court in WP(MD) 14456/2019 dated 28.06.2019 enabling the petitioner to get back the vehicle bearing Reg no. TN-34-D-3930 from the respondents and thus render justice Prayer in WP.
Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus, directing the respondents to release the petitioners vehicle bearing registration No. TN-34-D-3930 within a time as stipulated by this Hon'ble Court. ORDER:- This Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.Senthilkumar, Advocate for the Petitioner and of Mrs.D.Farjana Ghousia, Special Government Pleader for the Respondents, this Court made the following order: Learned counsel for the petitioner submits, on instructions, that no criminal proceedings were initiated and no R.P.R. has been assigned as on date.
2.By an order dated 28.06.2019, this Court directed the 3rd respondent to release the petitioner's vehicle within a period of one week from the date of receipt of a copy of the order, subject to https://www.mhc.tn.gov.in/judis 1/2
WMP(MD). No.5422 of 2023 the conditions specified therein, including the remittance of a sum of Rs.50,000/- (Rupees Fifty Thousand Only) by the petitioner to the 2nd respondent for deposit into the District Mineral Foundation Trust.
3.The petitioner submits that he was unable to mobilize the requisite funds due to his poor financial condition. He states that he has mobilized the funds now and seeks extension of time. 4.Upon considering the submissions of the petitioner and being satisfied that sufficient cause is shown, time for remitting the sum of Rs.50,000/- is extended by period of two weeks from the date of receipt of a copy of this order. If the petitioner remits the said amount within the said period and also complies with the other conditions in the order dated 28.06.2019, the 3rd respondent is directed to release the petitioner's vehicle.
