.. Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this court to issue a WRIT OF MANDAMUS directing the 1st Respondent to recover a sum of Rs.16,43,525/- 1/6

(Rupees Sixteen Lakhs Forty Three Thousand Five Hundred and Twenty Five only) from the 3rd Respondent based on the Award dated 15.02.2023 in W.C.No.15 of 2022 with subsequent interest at the rate of 12 percent till the date of realization of the award amount to the Petitioner within the time stipulated by this Court.

ORDER

The petitioner is before this Court seeking for a direction to the respondents 1 and 2 to recover a sum of Rs.16,43,525/- from the third respondent pursuant to the award dated 15.02.2023 in W.C.No.15 of 2022 with interest at the rate of 12%.

2. The son of the petitioners 1 & 2 and the brother of the third petitioner died during the course of employment and the competent authority under the Workmen's Compensation Act, awarded the said amount. Since the third respondent did not deposit the said amount, recovery certificate was issued and the first respondent initiated steps for recovering the compensation amount from the third respondent. However, the first respondent having initiated the proceedings is not making efforts to recover the compensation amount at the earliest.

Ms.PB.Ahamed Yasmin Parvin, learned Government Advocate appearing for the respondents 1 & 2, submitted that steps are taken for recover the said amount and compensation amount will be recovered from the third respondent in accordance with law within the time frame to be stipulated by this Court.

4. In light of the above, the Writ Petition is disposed of directing the first respondent to recover the amount pursuant to the award dated 15.02.2023 in W.C.No.15 of 2022 within a period of eight (8) weeks from the date of receipt of a copy of this order. No Costs.
